delay of Frazer and Company's telegrams is justified by mere

suspicion but rather that proof should come before such inter-

-ference with the ordinary course of trade.

Quoting further the instructions of the Department

of State to Ambassador Page, above referred to, I can but voice

the complaint of the Department of State against the British

government that "In spite of the presumption of innocent use be-

-cause destined to neutral ☛ territory, the British authorities

made these seizures and detentions without, so far as we are

informed, being in possession of facts which warranted a reasonable

belief that the shipments had in reality a belligerent destination

as that term is used in international law. Here suspicion is not

evidence and doubts should be resolved in favour of neutral

commerce, not againstit".

This office in line with the plain and repeated

instructions of its government is not disposed in the least to

cover anything in the way of unneutral conduct on the part of its

nationals. I am disposed to question somewhat the right of the

British Government to extend a municipal ordinance such as thạt

against trading with the enemy to transactions between even a belligerent in Canton and any person in a neutral country such as territory of the United States and basing such action upon the accidental control of property or communications in transit. I question whether a municipal ordinance of this sort can apply un- -til jurisdiction is had over the persons concerned, However, weiving that point for the time being, I can but again request from the Colonial Government such a statement of the facts on

which its action in the several cases is based as will enable

the American citizens concerned to present their cases with as little delay, difficulty and expense as possible.

Thanking the Colonial Government for its prompt

consideration of these matters in connection with the cases now

pending between this office and such government.
